In addition to our personalized services, we offer a selection of ready-made rehabilitation programs. These downloadable video sessions are perfect for individuals who prefer to recover at home while still receiving expert guidance. Our easy-to-follow videos cover a range of exercises that promote healing and strength, ensuring you stay on track throughout your recovery.

Welcome to Rehab with Dr. Lynn Maloney. These Terms and Conditions govern your access to use and use of our website, digital products, online programs, downloadable materials,videos, educational resources and related services.

By purchasing, accessing or using any of the programs, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not purchase or use any of the Offerings. 

Eligibility

You must be at least 18 years of age or the age of the majority in your jurisdiction to purchase or use the Programs.

By purchasing the Programs, you represent that you have legal authority to enter into this agreement.

Participation in the Programs does not establish a physical therapist-patient relationship or any other healthcare provider relationship. 

 

Nothing contained within the Programs should be interpreted as a substitute for evaluation or treatment by your physician, physical therapist or other qualified healtcare professional.  

Medical Disclamier

Recovering from surgery or injury varies significantly from person to person.

The exercises, timelines, milestones, recommendations, demonstrations and educational content included in the Programs are general guidelines and may not be appropriate for every individual.

You should always follow the instructions provided by your surgeon and healthcare team.

If your healthcare provider's recommendations differ from the Programs, you should follow the instructions of your healthcare provider.

Do not continue any activity that causes sever pain, increasing swelling, dizziness, chest pain, difficulty breathing, loss of balance, or other concerning symptoms. Seek appropriate medical care if these occur.

Assumption of Risk 

You understand that participation in exercise and rehabilitation activities carries inherent risks.

These risks may include, but are not limited to:

  • Muscle soreness

  • Muscle strains

  • Ligament injuries

  • Joint irritation

  • Increased swelling

  • Falls

  • Loss of balance

  • Delayed recovery 

  • Other injuries associated with physical activity

By participating in the Programs, you voluntarily assume all risks associated with your participation. 

Your Responsibility

You acknowledge that you are solely responsible for:

  • Determining whether the Programs are appropriate for you

  • Following medical advice from your healthcare providers

  • Performing exercises safely

  • Progressing at a pace appropriate for your recovery

  • Stopping any activity that appears unsafe

You agree to use reasonable judgement while participating in the Programs. 

No Guarantees 

Every recovery is different.

We do not guarantee any specific:

  • Recovery timeline

  • Functional outcome

  • Pain reduction

  • Range of motion 

  • Strength gains

  • Return to work

  • Return to sport 

  • Surgical outcome

Results depend upon numerous factors beyond our control. 

No Professional Relationship

Purchasing or using the Programs does not create:

  • A physical therapist-patient relationship 

  • A physician-patient relationship 

  • Any ongoing treatment relationship

  • Emergency medical services

  • Individualized rehabilitation services

Intellectual Property

All Program materials are protected by United States copyright and intellectual property laws.

  • Written Consent

  • Checklists

  • Branding

  • Website Content

Your purchase grants you one personal, non-transferable, revocable, non-exclusive license to use the Program for your own personal, non-commercial use.

You may not:

  • Copy

  • Share

  • Upload

  • Record

  • Screen capture for redistribution

  • Sell

  • Reproduce 

  • Publish

  • Modify 

  • Create derivative works 

  •  Distribute 

  • License

  • Transfer your account 

  • Permit others to access purchased materials

Unauthorized use may result in termination of access and legal action where appropriate.

User Conduct

Payment

Payment is due in full at the time of purchases.

Termination

We reserve the right to suspend or terminate your access without refund if you violate these Terms or engage in unauthorized use of the Programs. 

Disclaimer of Warranties

The Programs are provided "as is" and "as available."

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties or merchantability, fitness or a particular purpose, accuracy, availability and non-infringement. 

Limitation of Liability 

To the fullest extent permitted by the law, Rehab with Dr. Lynn Maloney, its owner, employees, contractors, affiliate, licencors and agents shall not be liable for any direct, indirect, incidental or consequential, special, exemplary or punitive damages arising from or related to your use of the Programs.

Your sole remedy for dissatisfaction with the Programs is to discontinue its use. 

Indemnification 

You agree to indemnify, defend and hold harmless Rehab with Dr. Lynn Maloney, its owner, employees, contractors, affiliates and agents from an claims, damages, liabilities, costs or expenses arising from your misuse of the Programs, violation of these Terms, or failure to follow appropriate medical advice. 

Privacy

Your use of our website if also governed by our Privacy Policy, which explains how we collect, use and protect your information. 

Governing Law

These Terms shall be governed by the laws of the State of Illinois, without regarding to conflict of law principles.

Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Illinois, and you consent to the jurisdiction of those courts. 

Severability

If any provision of these Terms is determined to be unenforceable, the remaining provisions shall continue in full force and effect. 

Changes to These Terms

We reserve the right to update these Terms at any time.

Entire Agreement
